What documents do I need for a Right to Work check?

The documents required for a Right to Work check depend on the citizenship status of the candidate.

  • For New Zealand citizens - Performing a Right to Work check on a candidate with permanent right to work in New Zealand, before they begin their employment with you, will last for the full term of their employment at your company. The documents required for a Right to Work check on a New Zealand citizen include a passport, birth certificate or citizenship documentation.
  • For non-citizens (including Australian citizens) - These candidates may have limited work rights in New Zealand, and it is important for employers to be aware of these limits. Along with their passport, they will need to provide their valid visa information. They will also need to have their right to work documentation re-checked when their permission to be in New Zealand comes to an end (this is based on the expiry date on the document used for the Right to Work check).

Do New Zealand citizens need a Right to Work check?

Yes. Employers should never assume someone's right to work in New Zealand. You can check a candidate's right to work using their New Zealand passport or documents stated above.

The standalone Visa check can be used for candidates who are known non-Zealand citizens to\ ensure they have a valid visa and permission to work in New Zealand.

Do volunteers need a Right to Work check?

If the work is genuinely voluntary with no payment for services, it is unlikely to require a Right to Work check, though this is subject to the discretion of the employer/overseer and any other checks or qualifications they may require.

For example, many charitable and non-profit organisations require police checks for all volunteers due to the vulnerability of their patrons or because the volunteers will work with children.
